I’m getting married this year and my fiance wants to adopt my son. There is no biological father in the picture and never has been so I should be the only parent giving consent to the adoption, I believe. We’ve priced attorneys and can’t really afford one right now and are wondering if we can do it ourselves but I can’t find any forms specific to Arkansas, nor do I know the procedure and guidelines for Adoption in Arkansas. Is this doable and what all do I need in order to be able to do it ourselves?
I live in Arkansas and I adopted my step daughter. You really do need a lawyer. Even if the biological father isn’t in the paper, you will have to show the court you tried to contact him. When I adopted my step daughter I paid $750 for the lawyer and $140 for the filing fee.
In Arkansas, there is no limit of time you must be married in order for your new husband to adopt, so as soon as you are married, he can file to adopt. After he files, it can go to court after 30 days. So he could adopt your child within 2 months of your marriage.
Keep checking around, I am sure you can get a lawyer fairly cheap. Also in Arkansas, if the bio father has not paid child support or tried to visit the child in a year, his rights can be terminated for legal abandonment.
A lawyer will make sure it is all done legally. You REALLY need a lawyer for this. This is not a do-it-yourself thing.

ok im looking for the consent to adopt form for my sons father to sign for the courts. cant find in anywhere unless i pay for it (the man isn’t paying child support as it is. going it without the lawyer) but i just cant find it. i was wondering if someone else has done a step parent Adoption in va and knows what the form looks like, where i can find it, or can possibly email me what they used. thank you so much!!!
Paying child support and relinquishing parental rights are two extreme things. He has rights still. Forget the form for now—you are trying to put the cart before the horse. This is a legal process and the court will handle it.And You think because he hasn’t pd child support you can waltz right in and the new man adopt your child.NO

We are in the process of a step parent adoption. I have a few questions for anyone that has been through it in los angeles county.
We have published a copy of the court hearing in the newspaper. The clerk at the court said SOMETIMES the judge terminates rights and finalizes the adoption right there? Has anyone had this happen?
Also, the court is asking us to send some form to the branches of the military. Does anyone know where to get this form online? I cant seem to find it.

Whose rights did the clerk say a judge might/can terminate?
Adoptions always have a time frame as far as my experience goes, so I doubt a judge would terminate rights of a birth parent and finalize Step Parent Adoption all at one moment in court.
You need to be more specific of EXACTLY WHAT FORM the judge told you to send to the branches of the military.
It sounds like you’re trying to adopt a step child whose birth parent is in the military and the judge wants to to send some form so the military can contact the birth parent and ask them if they are willing to give up parental rights.
How can we tell you where to get the form online? You didn’t tell us WHAT form! You must have been give an exact form name and/or form number by the judge. With that name/number you should have little trouble finding the form.

When my daughter was a year old I got married and we started the Step Parent Adoption process. We had her father served with papers and he answered by saying he did not object to the process because he did not believe she was his child. We never had a DNA test done and the Adoption went thru. Fast forward 12 years, we are now divorced and her real father has contacted me and wants a test so he can say that the adoption should not have gone thru with out one. He wants to see her and have rights again, can it be done?? She knows about him and would like to meet him and I would not keep them from doing that, however I have not told my my ex about it yet. He pays support and visits with her EO weekend so he is in her life.
You have to check the statutes of limitations in your state. In most cases, once a DNA test is done, the legal and true father is instated on the birth certificate. The issue is whether or not your ex-husband (the adopter) will have to sign away rights to his "now" daughter.
Just my 2 cents:
Why would you jump to this court stuff before getting the "true" dad involved in your daughters life. I would test the waters before getting too involved in the court process. After 12 years of wanting nothing to do with his child, all of a sudden he is interested… I would tread lightly if I were you. Neither you nor your daughter need him changing his mind again and taking off. You have to be careful….

my husband wants to adopt my son. need some advice or good websites to check how to do this. my sons dad has not been in his life in 11 years and he is incarserated. so do i need his permision. what if he wont sign his rights over. is there a way around that. my husband is my sons father he raised my son since he was a baby n its the only father my son knows. i think he has a right to adopt him.
You can contact legal aid in your area and see if you qualify. Another option is to contact family law attorneys in your area and see what the cost is. When I adopted my step daughter it was $750 for the lawyer and $140 for filing fee.
As for the bio father’s rights, even if he is incarserated he still has his rights. I am not sure you can force termination if he is in prison. If he signs away his rights and consents to the Adoption then you’ll have no problem. You really need to ask a lawyer about if you can still proceede while he is in prison.

I was not asking about adopting a step parent I am talking about a step parent adopting their step child GEEZ!!!!!!!!!!!!!!!!
As far as I know, it is not possible to adopt a step-parent anywhere.

I know that for a step parent to adopt, there has to be consent from the other biological "parent" (regardless of the other biological parent having no guardianship or anything)
So say the other bio parent objects to the Adoption, and then it goes to court….
What sorts of things does a judge look at to decide if the child should or shouldn’t be adopted??
Unless the natural parent has abused the child, and it has been proven in a court of law, or the natural parent agrees to willingly surrender their parental rights, courts usually do not allow Step Parent Adoptions to happen. They shouldn’t.
A court will look at everyone’s court/criminal history. They wont terminate just because new Mommy/Daddy wants to adopt them.
Parents should never have their parental rights terminated unless there is neglect or abuse & the parent cannot or will not rehabilitate.

the step parent gave all signed forms to their lawyer
filled out the tpr and they said paper work was submitted to their lawyer on april 20th.
when should i call the courtto see if they received the papers, and will i recieve anything in the mail.
You can call anytime to see what the next step is and when that will be. You need to appear in court before the Judge to make the Adoption legal. It probably takes around 3 months.

I recently completed a Step Parent Adoption with my wife, who just filed for divorce. I know the child’s biological father would be glad to be reinstated as the father.
Yes you can but the court will not look upon it kindly.
The court needs to do a re-haul on terminations and Adoptions by step parents.
